It looks like poor THQ are in even more hot water at the moment with one disgruntled tattoo parlour owner for using one of his designs without permission in UFC Undisputed 3. The tattoo in question is used my martial arts fighter Carlos Condit but is owned by Chris Escobedo who owns and runs Elite Tattoo in Arizona. Chris is now seeking damages from THQ for copyright infringement, the last thing that THQ needs in its battle for survival.
Chris claims that he would not have agreed for THQ to use his artwork without, at the minimum, approving his artwork, and also receiving some king of remuneration in return. “People often believe that they own the images that are tattooed on them by tattoo artists, said Mr Escobdeo's legal counsel Maria Crimi Speth. 'In reality, the owner of the tattoo artwork is the creator of the work, unless there is a written assignment of the copyright in the tattoo art.”
The claimants position is considered to be a strong one as the makers of hangover 2 faced a similar issue for the reproduction of Mike Tyson’s facial tattoo without permission but was settle out of court but legal experts suggest that the film makers would have lost if the case would have made it to court.
