The Australian Competition and Consumer Commission (ACCC for short) who took Apple to court saying Apple were breaking consumer laws and misleading customers in Australia, seem to have got a result.
The ACCC who were seeking “injunctions, pecuniary penalties, corrective advertising and refunds to consumers affected” and the reason given by the ACCC is "That Apple's recent promotion of the new "iPad with WiFi + 4G" is misleading because it represents to Australian
consumers that the product "iPad with WiFi + 4G" can, with a SIM card, connect to a 4G mobile data network in Australia, when this is not the case."
At the preliminary hearing Apple lawyer Paul Anastassiou said Apple had never claimed the iPad WiFi + 4G would work on the current 4G data network operated in Australia by Telstra but the device does work on what is the globally accepted to be a 4G data network
Apple are said to now be issuing refunds to customers in Australia who feel that they were misled however apple are not accepting that they have mislead any of their customers.
The case will continue and go to a full trial on May 2nd.
